1. Purpose 

This is a Time for Photos (TFP) agreement. No money will be exchanged. All parties agree to collaborate and allow use of the images for portfolios, self-promotion, and social media. Participation in this shoot is voluntary. 

2. Copyright 

The Photographer retains full copyright of all images and video taken by them during the shoot. All other involved parties are granted a non-exclusive, non-transferable, non-sublicensable licence to use the final edited  images for personal portfolio, social media, and promotional purposes only. Images may not be sold, licensed, submitted for commercial advertising, or otherwise commercially exploited by any party without the written permission of the Photographer. 

3. Design Ownership

The Photographer/Designer retains full ownership and intellectual property rights in any garments, accessories or props created for the shoot. No other party may reproduce, copy, adapt, or commercially exploit these designs without prior written permission. 

4. Image Selection and Delivery 

The Photographer will select and edit a minimum of five final images and deliver them to the other parties - usually within 4 weeks but on occasion may take longer. If this is the case, the Photographer will endeavour to keep all other parties updated with timescales. It should be assumed that after delivery of the images, all suitable images have been delivered and requests for any additional images are likely to be denied.

 

Within 3 days of the shoot, if requested, the Photographer will provide all parties involved with “sneak peek” images from the shoot. This will usually constitute 1-3 unedited images. These images may not be used or posted to social media as they will not be final images. 

 

After delivery of the final gallery, as a courtesy, the Model will have up to 4 weeks to post the images on social media  first. After this time, if the Model has not posted the images, the Photographer reserves the right to post the images. Within the 4 weeks courtesy period, once the Model has posted any of the images, the Photographer and HMUA may also post the images in accordance with this agreement. 

 

If there are any images which have been delivered, and which the Model objects to being used in the final gallery, the Model must provide their objection and reasons within 7 days of the delivery of the final gallery.  The final decision over the inclusion of images in the final gallery remains with the Photographer. 

 

Images will be delivered via a link to a Lightroom gallery.  Models and HMUA should ensure that they have downloaded the images upon receipt of the link, as the Photographer does not guarantee long term storage. 

 

5.Image Use & Rights 

All above named parties may use the agreed images for their portfolios, websites, and social media accounts. All parties agree to credit each other appropriately when posting images. 

 

The Model grants the Photographer permission to use the Model’s likeness in the images, in perpetuity and worldwide for portfolio, editorial, magazine submission, exhibition, website and social media purposes. Images will not be used in a defamatory, misleading or unlawful manner. 

6. Age Confirmation

By signing this agreement, the Model confirms that they are over 18 years of age and legally able to enter into this agreement. 

7. Edits and Alterations 

The Model and HMUA agree not to edit, alter, or apply filters to any of the images without the Photographer’s written permission. 

8. Behind the Scenes Content 

If any party shares behind the scenes (BTS) content, they agree to give appropriate credit to everyone involved where reasonably possible (e.g., tagging Photographer, Designer, Model, HMUA, etc.). 

The Photographer may use a body worn camera to capture BTS footage however the video camera will only be used with the consent of all parties who are present at the shoot. Any videos which use this BTS footage may be used by the Photographer and all relevant parties will be tagged on social media and may be reshared by the other parties. 

No BTS footage may be taken while the Model is in a state of undress. Any such images or footage which is accidentally taken while the Model is in a state of undress must be deleted.  

9. Chaperones 

Each party may bring one female chaperone for comfort and safety if they wish. Chaperones must not interfere with the shoot or the creative process. They may take BTS content as long as the use of the BTS images/footage respects the terms of the agreement. 

If the Photographer brings an assistant (for example, to capture behind-the-scenes footage or assist with the shoot), the assistant also agrees to follow the terms of this agreement.

10. Signatures 

By signing, all parties confirm they have read, understood, and agree to the terms outlined in this agreement.
